Terms and Conditions
These terms apply to enquiries, proposals and bookings made with Himalayan Luxury Tours ("we", "us") through www.HimalayanLuxuryTours.com, by phone, WhatsApp or email. By paying an advance or confirming a booking, the lead guest accepts them for everyone in the party.
1. Definitions
"Guest" means every person travelling. "Proposal" means our written itinerary and quotation. "Confirmation" means our written acceptance of the booking after the advance payment is received. "Force majeure" means an event beyond our reasonable control, such as natural disasters, landslides, floods, snow, road closures, strikes, bandhs, political unrest, security restrictions, pandemics, war, government orders or extreme weather.
2. Bookings and payment
A booking is confirmed only when we issue a written confirmation and receive the advance stated in it. The advance secures services with our partners and is non-refundable unless we state otherwise in writing.
The balance must reach us by the date shown in your proposal or invoice. If it does not, we may cancel the booking and retain the advance. For bookings made close to departure, full payment may be required at the time of booking.
Payments are accepted by bank transfer or another method we confirm in writing. Please pay only to the account details we send from our official contact numbers or email. Keep your payment receipt and send us the transaction reference.
3. Prices and inclusions
Prices are quoted in Indian Rupees unless stated otherwise, and depend on the group size, dates, hotel category and services listed in your proposal. Final confirmation of hotel category, room sharing, vehicle capacity and availability is required before booking.
Only services listed as included are covered. Unless confirmed in writing, items such as air or train tickets, lunches, drinks, entry tickets, camera fees, optional activities, local union taxis, snow vehicles, pony rides, laundry, tips and personal expenses are excluded. Prices may change because of taxes, fuel, currency changes or supplier increases before confirmation. After confirmation we will not change the price except for government-imposed changes.
4. Services and third parties
We arrange accommodation, transport, guides and activities through independent partners. Services depend on availability, season, weather, permits and local conditions. Where a partner's service changes, we will offer a suitable alternative where possible, and the difference in cost, if any, will be shared with you.
5. High season, traffic and service delays
Peak seasons and holiday periods, such as festivals, school holidays, long weekends, the summer and autumn tourist seasons and winter snow periods, bring heavy traffic, crowded attractions and tight supply of rooms and vehicles. During these times you should expect:
- Longer road journeys, queues at checkpoints, viewpoints and ticket counters, and later arrivals than planned.
- Delayed check-in or early check-out, and rooms assigned at the property's discretion.
- Slower service in restaurants and at attractions, and limited availability of local taxis, boats, cable cars or activity slots.
- Changes to sightseeing order, timings or places visited to make the best use of the day.
- Replacement of a hotel or vehicle with a similar category when the original is unavailable.
These are normal operating conditions in the travel industry. They do not entitle the guest to a refund or compensation, but we will always try to keep the plan as close to your proposal as is safe and practical.
6. Travel documents, permits and health
Guests are responsible for valid photo identification, visas, permits and entry documents, and for carrying them while travelling. We help arrange permits where possible, but approval is the decision of the authorities. Guests must be fit for the planned activities and disclose any medical condition or mobility need beforehand. Travel insurance, including medical cover and evacuation for high-altitude and remote journeys, is strongly recommended.
7. Health, safety and risk
Mountain and outdoor travel carries risks, including accident, illness, altitude effects, wildlife, weather and road hazards. Guests accept these risks and must follow the instructions of guides and drivers. Children must be supervised by an adult at all times. We may refuse or end an activity if we believe it is unsafe.
8. Changes by the guest
Please tell us as early as possible about changes to dates, names or services. Changes depend on availability and partner conditions, and any extra cost is payable by the guest.
9. Changes to the itinerary
We may change or reorder the itinerary because of weather, road conditions, traffic, safety, permits, local rules, supplier changes or force majeure. No refund is given for services not used, early departure or missed activities, except where a partner refunds us.
10. Cancellations and refunds
See our Cancellation Policy.
11. Force majeure
If force majeure affects a journey, we may alter, delay or cancel it. Where possible we will offer an alternative or a credit. Refunds are made only to the extent that our partners refund us. Extra costs from such events, such as additional nights, transfers or meals, are payable by the guest.
12. Accommodation and transport
Check-in and check-out follow each hotel's or houseboat's policy. Room types and sharing follow the proposal. Vehicles are used for the itinerary only and are not available for personal trips, and local or union vehicles may be required at some destinations under local rules.
13. Conduct and responsible travel
Guests should respect local customs, religious places, wildlife and the environment, and follow local laws. We may end the services of any guest whose conduct puts others at risk or damages property, without refund. Guests are responsible for damage they cause.
14. Limitation of liability
We take reasonable care in planning and in selecting partners. Our liability is limited to the amount paid to us for the booking. We are not responsible for loss, injury, delay or damage caused by third parties, force majeure, or the guest's own acts, or for loss of personal belongings.
15. Complaints
Please raise any concern with us immediately during the journey so that we can try to resolve it on the spot. Written complaints after the journey should reach us within 15 days of the end of the trip.
16. Governing law
[Governing law and jurisdiction to be added by your legal adviser.]
